ये कहानी है एक ऐसे इंसान कि जिसने अपनी ज़िंदगी के 29 साल एक ऐसे ज़ुर्म के लिए काटे जो शायद उसने किया ही नहीं था, और अगर किया भी होता तो क्या उसे इसकी इतनी बड़ी सजा मिलनी चाहिए थी? ये कहानी है हरजिंदर नगर, कानपुर निवासी उमाकांत मिश्रा कि जिन्होने 57.60 रुपये कि चोरी कि सजा 29 साल तक भुगती. बात है 23 जुलाई 1984 की. उमाकांत हरजिंदर नगर स्थित पोस्ट ऑफीस मे काम करते थे. उनके ऊपर 57 रुपये 60 पैसे चोरी का इल्ज़ाम लगा और उनको नौकरी से निकाल दिया गया.

"उस दिन मुझे कुल 697 रुपये 60 पैसे दिये गये थे जिसको मुझे मनी ऑर्डर के अंतर्गत लोगों के घर पे पहुचना था. मैंने ३०० रूपए के मनीऑर्डर बांटे और बचे हुए रूपए पोस्ट ऑफिस में लौटा दिए. जब शाम को सारा हिसाब किताब हुआ तो 57 रुपये 60 पैसे कम पाये गये. मुझ पर धोखाधड़ी का आरोप लगाया गया और नौकरी से निस्काशित कर दिया गया. मेरे खिलाफ एफ आई आर भी दर्ज की गई."

उमाकांत को धोखाधड़ी के आरोप मे जेल भेजा गया. उनको उस समय तो बेल मिल गई और वो रिहा हो गये मगर इसके बाद उनकी ज़िंदगी मे 29 साल तक चलने वाली लड़ाई शुरू हुई. जब वो सस्पेंड किये गये तब उनकी उम्र 30 साल थी. तब से लेकर आज तक उन्होने कोर्ट मे कुल 348 सुनवाई मे हाज़िर होना पड़ा जिसमे आखिरकार उन्होने अपने आप को निर्दोष साबित किया, मगर 29 साल के दौरान उन्होने जो खोया उसकी भरपाई कोई नहीं कर सकता.

"मॅ 3 साल पेहले रिटायर हुया और 26 साल तक निष्काषित रहा, अब मॅ क्या कहूँ या क्या करू? मुझे 348 बार कोर्ट की तरफ से सम्मन् भेजा गया. मुझे अपना कानपुर का घर बेचना पड़ा और उसके बाद मैने हरदोई स्थित अपना खेत भी बेचा. हम दिवालिया हो गये."

उनकी पत्नी गीता का कहना है-

"हम कोर्ट के न्याय से खुश हैं मगर यदि ये न्याय हमे सही समय पर मिला होता तो आज हम ज़्यादा खुश होते. हमारे बच्चों की शिक्षा अच्छे से हुई होती. हमने 29 साल एक ऐसे कलंक के लिये झेले रुपये हम दोषी नहीं थे. हम आर्थिक रूप से पूरी तरह से खतम हो गये, हमारे बच्चो का भविष्य भी नहीं अच्छा हो पाया. इससे बुरा शायद ही कुछ हो किसी के साथ. हमने सब कुछ खोया. हमे अपनी जीविका चलने के लिये उधार लेना पड़ा क्योंकि हमारी कोई नियमित आय नहीं थी. हमे हमारे बच्चों की शिक्षा और शादी के लिये बहुत परेशानी उठानी पड़ी. हमारी बच्चियों की विवाह के लिये हमे लोगों से डोनेशन लेना पड़ा. हम अपने बच्चों को पढ़ा नहीं पाये जिसकी वजह से हमारा बेटा गंगा एक असुरक्षित नौकरी कर रहा है."

गंगाराम दिल का मरीज़ है और उसकी सर्ज़री का खर्चा पांच लाख के आसपास है.

"हमारे पास बिल्कुल भी पैसे नहीं हैं. हम अपने बच्चे को सिर्फ मरते हुये देख सकते हैं जैसे हमने अपने बाकी तीन बच्चों को देखा है."

सस्पेंड होने के बाद से ही उमकांत तो सरकार से एक पैसे की भी सहायता नहीं मिली जबकि वो निर्वाह भत्‍ते के लिये नामित थे. उनकी तीन साल की बेटी निक्कू की मृत्यु डायरिया की वजह से हो गई. वो उसका इलाज नहीं करवा पाये क्यों की उनके पास पैसे नहीं थे. यही नहीं, उन्होने अपने दस साल के बेटे दयाशंकर और सात साल के बेटे दुर्गेश को भी टीबी और निमोनिया के चलते खोया.

उमाकांत और गीता किसी तरह अपना जीवन निर्वाह कर रहे हैं. कोई नौकरी मिल जाती है तो ठीक वरना मजदूरों की तरह काम करते हैं. उन लोगों को फिलहाल उनकी बकाया तन्खा, पेंशन और गंगाराम के लिये एक नौकरी चाहिये.

Story of a man who spent 29 years of his life for a punishment that probably was not done by him and even it was done by him, he got the judgement so late?

Mr. Umakant Mishra, a Harjinder Nagar- Kanpur (Uttar Pradesh) resident who spent 29 years of his life in getting a judgment of a theft of 57.60 Rupee. That was on July 13, 1984. He was working at Harjinder Nagar post office. A case was registered against him for stealing 57.60 rupees and immediately got suspended. City police booked him under the criminal case of breach of trust.

"That day I was given 697 rupee and 60 paisa whom I had to distribute with money orders to people. After coming back to office in the evening I returned rest of the money after distributing 300 rupees. When all calculation ended, my senior accused me of stealing 57.60 rupee and lodged FIR against me. I was immediately suspended."

Umakant was sent to jail on the charge of forgery. That time he got bail after that a real fight of his life started. He was 30 years old when he got suspended. From then he attended total of 348 hearings in the court and finally he proved himself innocent. Court sent him free on the basis of lack of evidence from complainant. But during these 29 years, he lost almost everything.

"I retired 3 years back and was suspended during 26 years. What I should do or what i should say? I attended hearing 348 times. I lost my Kanpur home and after that I sold my agricultural land at Hardoi (Uttar Pradesh). We are bankrupt."

His wife Geeta says:

"We are happy with the verdict but if we would have got justice at the right time, our children's career wouldn't have ruined. We lived with stigma and financial trouble for so long. Economically we are totally lost. We lost everything. This was worst. We borrowed money for our livelyhood, children's education and marriage because have no regular income. We passed through every trouble. We sought donation to marry off our two daughters. Since we could not educate our children, our son Gangaram is doing a insecure job."

Gangaram is a heart patient and it will cost 5 lac for his surgery.

"We have no money. We can just see him dying like our other 3 kids."

From the day of suspension, Umakant did not get a single penny form the government though he was entitled to subsistence allowances. His 3-year-old daughter died of diarrhea. She died because they could not avail of her treatment. Not even this, he lost his 10-year-old son Dayashankar and 7-year-old son Durgesh who died of TB and pneumonia.

They are spending their life anyhow doing odd jobs or doing labors. Now they want their pending salary, pension and a government job for their son Gangaram.
