Twenty four years ago in 1989
The village of Simi Jhanda in Punjab is plagued by police brutality and
corruption. The police arrest villagers without filing any complaints or
FIRs, accusing them of being militants, and then torture them until their
families pay a ransom for their release.
Harjeet, a literate villager who knows the proper procedures for arresting
suspects, intervenes when he sees the police beating a villager. He demands
to see a copy of the FIR or complaint against the suspect, which the police
cannot provide. This happens repeatedly, and Harjeet becomes a thorn in the
side of the police.
Harjeet eventually becomes the Sarpanch of the village and educates the
villagers about the illegal activities of the police. He also spreads
awareness to neighboring villages.
However, the police decide to take revenge on Harjeet. They accuse him of a
recent murder in the village and arrest him. They torture him severely and
then tell his family that he has run away and is now dead.

पंजाब का सिमी झन्डा गाँव जहाँ के गाँव वाले पीड़ित है पुलिस की गुंडागर्दी से.
पुलिस वहां के किसी भी व्यक्ति को उठा लेती है और बेवजह सिर्फ शक की बिनाह पर
उनको बुरी तरह से मारती पीटती है और अरेस्ट कर के ले जाती है. उसके पास बहुत से
बहाने होते हैं व्यक्ति के परिजनों को बताने के लिए जैसे की इस व्यक्ति पर
उग्रवादी होने का शक है या ये उग्रवादियों से सम्बन्ध रखता है. इसी बहाने पुलिस
वाले इस व्यक्तियों के परिजनों से मोती रकम वसूलते हैं अपनी जेबें भरने के लिए.

हरजीत राजावत भी गाँव का एक जागरूक व्यक्ति है. वो एक बार पाने सामने पुलिस को एक
व्यक्ति की पिटाई करते देखता है. वो पुलिस वालों को बोलता है की बिना किसी सबूत,
या ऍफ़.आई.आर. के बिना वो लोग किसी को इतनी बेरहमी से कैसे मार सकते हैं. इसी तरह
से जीत कई लोगों को पुलिस का चंगुल से बचाता है. पुलिस उसको धमकी देती है की वो
इस तरह से मामलों में बीच में ना आये वरना उसके साथ भी बुरा होगा.
जीत ये तय करता है की वो गाँव से सरपंची का चुनाव लड़ेगा. जीत गाँव का सरपंच बन
जाता है. वो लोगों को पुलिस से जुर्म के विरुद्ध जागरूक करता है. साथ ही साथ वो
आसपास के गाँव के लोगों को भी जागरूक करता है. वो बाकी गाँव के सरपंच को साथ लेकर
पुलिस से मिलता है और पुलिस को समझाता है की अगर पुलिस को किसी पर शक है तो वो
कानून के दायरे में रह कर ही कार्यवाही करे.
पुलिस के लिए जीत एक रस्ते का काँटा बनता जा रहा है. इसी दौरान पुलिस के सामने एक
हत्या का केस आता है और वो हत्या के शक के बिनाह पर जीत को गिरफ्तार कर लेते हैं
और बहुत निर्दयता से मारते हैं.
The case of Kuljit Singh Dhatt, the nephew of Shaheed Bhagat Singh's sister,
in 1989, remains controversial. Five Punjab policemen conspired to abduct
and later eliminate Kuljeet. His body was never found. Kuljeet's elder
brother Harbhajan Singh Dhatt is the son-in-law of Shaheed Bhagat Singh's
youngest sister, Prakash Kaur. Kuljeet was arrested on the night of January
25th and 26th, 1989, and an FIR was lodged two days later. The FIR claimed
that Kuljeet had confessed to hiding a load of weapons and ammunition on the
banks of the river Beas. The FIR also stated that Kuljeet had led the police
to the weapons and then jumped into the river while wearing chains.
In 1990, Kuljeet's wife and Prakash Kaur went to the Supreme Court, which
set up an inquiry commission. The commission submitted its report in 1993,
which indicated that Kuljeet had been abducted and eliminated. The accused
were charged with criminal conspiracy, abduction, and illegal confinement.
The case remained pending in court for nearly 14 years, during which time
Prakash Kaur, who was based in Canada, moved to the Supreme Court to request
an early hearing. By this time, two of the accused had already passed away.
On May 9th, 2014, the court sentenced three accused to five-year rigorous
imprisonment under section 364 of the Indian Penal Code (IPC) and a fine of
2.1 lakh each.
Prakash Kaur, the youngest of Shaheed Bhagat Singh's nine siblings, passed
away on September 28th, 2014, which was also the 107th birth anniversary of
Shaheed Bhagat Singh. During the hearings of the Kuljit Singh Dhatt case,
Prakash Kaur had moved to Canada and was living with her son Rupinder Singh
Mali. She had been paralyzed for the last six years of her life.
Prakash Kaur Passes Away:
Prakash Kaur was born in 1921, and she was only 12 years old when
Bhagat Singh, Sukhdev, and Rajguru were executed by the British on March
23rd, 1931. Prakash was married to Harbans Singh Malhi from 5 NN village in
Padampur tehsil of Ganganagar district in Rajasthan. Her husband passed away
15 years prior to her death.
According to Kuljeet's brother Harbhajan, Prakash fought for justice for 25
years and filed a petition for the reconsideration of the punishment for the
three accused in the Punjab and Haryana High Courts.

कुलजीत को पांच पुलिस वालों द्वारा गायब कर दिया गया था जिसके बाद उसे मार दिया
गया और लाश किसी को सौंपी गई यहाँ तक की किसी को पता भी नहीं चला की लाश का हुआ

शहीद भगत सिंह की सबसे छोटी
बहन प्रकाश कौर के दामाद हैं.
कुलजीत को 25 और 26 जनवरी की मध्यरात्रि को पुलिस ने अरेस्ट किया था और लोगों के
2 दिन बाद ऍफ़ आई आर दर्ज करी. ऍफ़ आई आर में ये लिखा गया की कुलजीत ने ये क़ुबूल
किया था की उसके पास हथियार और गोल बारूद था जो की उसने व्यास नदी के तट पर छिपा
दिए थे. पुलिस के अनुसार कुलजीत उनलोगों को हथियार तक ले गया था और वही पर वो
हथकड़ी तोड़ कर नदी में कूद कर भाग गया.
1990 में प्रकाश कौर और कुलजीत की पत्नी ने इन्साफ के लिए सुप्रीम कोर्ट का
दरवाज़ा खटखटाया और इसके बाद इन्क्वारी कमीशन बिठाई गई और 1993 में इस कमीशन ने
रिपोर्ट को कोर्ट के समक्ष प्रस्तुत किया जिसके बाद पांच पुलिस वालों को दोषी
ठहराया गया. बाद में सुप्रीम कोर्ट ने इन पुलिस वालों के खिलाफ केस को रजिस्टर
किया. इन पुलिस वालों को आपराधिक साजिश, अपहरण और अवैध कारावास के आधार बुक किया
गया.
ये केस करीब 14 साल तक हाई कोर्ट में पड़ा रहा. प्रकाश कौर जो की कनाडा निवासी
हैं, उन्होंने सुप्रीम कोर्ट का दरवाजा खटखटाया ताकि केस पर तेजी से काम हो सके.
इसी बीच इस केस के दो आरोपियों की मृत्यु भी हो गई और 9 मई 2014 को तीन बचे
आरोपियों को कोर्ट ने पांच साल की कैद और 2 लाख, 10 हज़ार रुपये जुरमाने की सजा
दी.
प्रकाश कौर की मृत्यु
प्रकाश कौर शहीद भगत सिंह के नौ भाई बहनो में सबसे छोटी थी जिनका देहांत 98
उम्र में ब्राम्प्टन,कनाडा में 28 सितम्बर, 2014 को हो गया जो की शहीद भगत सिंह
की 107वि जयंती भी थी. प्रकाश कौर इस केस के दौरान ही कनाडा शिफ्ट हो गई थी और
अपने बड़े बेटे रुपिंदर सिंह माली के साथ रह रही थी. प्रकाश कौर करीब पिछले छेः
साल से पैरलाईज़्ड थी. प्रकाश कौर का जन्म 1921 में हुआ था और जब भगत सिंह को जेल
हुई तब वो सिर्फ 12 साल की थी.
प्रकाश कौर की शादी राजस्थान के गंगानगर डिस्ट्रिक्ट के पदमपुर गांव निवासी हरभान
सिंह माली से हुई थी और वो कनाडा शिफ्ट हो गए थे. उनकी मृत्यु करीब पंद्रह साल
पहले हो चुकी है. हरभजन सिंह के अनुसार प्रकाश कौर ने ये केस पूरे 25 साल तक लड़ा
और इस केस का फैसल आने के बाद भी फैसले की सज़ा बढ़ाने की अपील पंजाब और हरयाणा
कोर्ट में करी थी.
